Comprehensive Terms of Service
Document Version: 3.0 | Last Updated: March 24, 2026 | Governing Jurisdiction: India
1. Contractual Foundation & Acceptance
These Comprehensive Terms of Service ("Agreement") constitute a legally binding contract between SolarGo ("Company", "we", "us", "our"), a registered solar installation company located in New Delhi, and you ("Client", "User", "you"), whether personally or on behalf of an entity. This Agreement governs your access to and use of the solargo.site website as well as any professional solar installation services provided by our Company.
By accessing the website, requesting a site survey, or engaging our professional services, you acknowledge that you have read, completely understood, and expressly agree to be bound by all terms contained herein. If you do not agree with any provision of these terms, you are expressly prohibited from using our services and must discontinue use immediately.
2. Scope of Professional Services
SolarGo provides comprehensive rooftop solar panel installation services for residential, commercial, and industrial properties in the Delhi NCR region. Our specific deliverables are customized per client and detailed in individual service proposals, but generally encompass:
- Site Survey & Engineering: Physical inspection of rooftop area, shadow analysis, structural integrity assessment, and load calculations.
- System Design & Procurement: Sourcing of Tier-1 solar panels, inverters, mounting structures, and balance of system (BOS) components.
- Installation & Commissioning: Physical installation of the solar plant, electrical wiring, earthing, and system testing.
- Regulatory Coordination: Facilitating net metering applications with local DISCOMs and PM Surya Ghar subsidy applications with MNRE.
CRITICAL DISCLAIMER: GENERATION & SUBSIDY VARIABLES
SolarGo operates with complete transparency regarding solar power generation and government processes. We explicitly state the following:
- Generation Estimates: Any figures provided regarding expected daily/monthly power generation or financial savings are professional estimates based on historical weather data and system capacity. We DO NOT guarantee exact generation figures, as these are dependent on uncontrollable variables including weather, pollution levels, grid stability, and panel cleaning frequency.
- Government Subsidies: While we assist fully with the PM Surya Ghar subsidy application, the final approval and disbursement of subsidy funds are entirely at the discretion of the government (MNRE) and the designated nodal agencies. We DO NOT guarantee the approval or the timeline for receipt of subsidy funds.
- Net Metering Timelines: The approval and installation of net meters are controlled by the local DISCOM (e.g., BSES, Tata Power). We DO NOT guarantee specific timelines for net meter installation.
3. Client Obligations & Site Readiness
The successful installation of a solar power plant requires client cooperation. The Client agrees to:
- Site Access: Provide our engineering and installation teams with clear, safe, and uninterrupted access to the roof and electrical panels during agreed-upon working hours.
- Documentation: Provide accurate electricity bills, property ownership documents, ID proofs, and photographs as required for DISCOM and MNRE applications within 3 business days of request.
- Structural Integrity: While we conduct a basic assessment, the Client is ultimately responsible for ensuring the building structure can support the weight of the solar plant. We recommend an independent structural audit for older buildings.
- Grid Availability: Provide a stable grid connection for system testing and commissioning.
4. Financial Parameters & Payment Terms
Standard Payment Schedule
Solar installations require significant upfront capital expenditure for procurement of major components (panels and inverters). Therefore, we operate on a strict milestone-based payment structure.
- Booking Advance: 10% of total project cost upon signing the contract and finalizing the design.
- Material Delivery: 60% of total project cost upon delivery of solar panels, inverter, and mounting structure to the client's site.
- Installation Completion: 25% upon completion of physical installation and internal testing.
- Commissioning: Final 5% upon successful net meter installation and system synchronization with the grid.
- Late Payments: Delays in milestone payments will result in an immediate halt of installation work. Materials delivered to the site remain the property of SolarGo until full payment is received.
5. Warranties & Maintenance
Manufacturer Warranties: Solar panels typically carry a 25-year performance warranty and 10-year product warranty. Inverters typically carry a 5-10 year warranty. These warranties are provided directly by the respective Original Equipment Manufacturers (OEMs). SolarGo will assist the client in raising warranty claims with the OEMs.
Workmanship Warranty: SolarGo provides a comprehensive 5-year warranty on our installation workmanship, including the mounting structure integrity and electrical wiring connections, provided the system is not tampered with by unauthorized personnel.
Maintenance: Unless an Annual Maintenance Contract (AMC) is explicitly purchased, the Client is responsible for regular cleaning of the solar panels (recommended every 15 days) to ensure optimal generation.
6. Termination & Project Cancellation
Pre-Material Procurement: If the Client cancels the project after paying the booking advance but before materials have been ordered or dispatched, SolarGo will refund the advance minus a ₹5,000 engineering and administrative fee.
Post-Material Dispatch: Once solar panels and major components have been dispatched to the site, the project cannot be canceled without the Client incurring significant restocking fees (typically 15-20% of the material cost) and bearing all transportation expenses.
7. Limitation of Liability & Force Majeure
To the maximum extent permitted by applicable law, SolarGo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of expected savings, business interruption, or grid failure damages.
Force Majeure: SolarGo shall not be liable for any delay or failure to perform its obligations under this Agreement if such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, severe weather, pandemics, government restrictions, DISCOM delays, or material supply chain shortages.
8. Governing Law & Dispute Resolution
This comprehensive agreement shall be governed by, construed, and enforced in accordance with the laws of the Republic of India. Any legal disputes, controversies, or claims arising from or relating to this engagement shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.
